FunsteadGAMES Coming soon

The short version

  • You buy Funstead once, through the App Store or Google Play. There are no ads, no in-app purchases and no subscriptions.
  • Refunds are handled by Apple or Google.
  • Your photos and stories are yours. On the phone, we never even see them.
  • If your family uses Family Connect (coming in December 2026), only add photos you have the right to share, be kind, and use the report tools if something isn't right.
  • The games are for fun. They're not a medical or health product.
  • We work hard to make Funstead reliable, but we can't promise it will be perfect, and our responsibility is limited as described below.
  • California law applies. If something goes wrong, please write to us first at support@funsteadgames.com and we'll try to make it right.

1. Who we are and what these terms cover

Funstead Games is made by Puff Together LLC, doing business as Funstead Games, a California limited liability company ("Funstead", "we", "us"). These terms are an agreement between you and us about:

  • the Funstead Games app for iPhone and Android ("the app", listed in the stores as "Funstead: Photo Games");
  • our website, funsteadgames.com; and
  • from the day it launches, Family Connect: our family website, family.funsteadgames.com, and the parts of the app that connect to it (Section 6).

Together we call these "Funstead". Our Privacy Policy (funsteadgames.com/privacy) explains how we handle information, and is part of these terms.

By buying, installing or using Funstead, you agree to these terms. If you don't agree, please don't use Funstead (and see Section 3 about refunds).

Setting it up for someone else? Many people buy Funstead for a parent or grandparent. If you set it up for someone, please let them know these terms apply to their use too. You're responsible for making sure they're happy to use it.

Age. You must be an adult (18 or older) to buy Funstead or to create a Family Connect account. Children may play the games on a grown-up's phone, with that adult's permission.

2. Your licence to use the app

The app is licensed to you, not sold. When you buy it, we give you a personal, non-exclusive, non-transferable licence to download, install and use the app on Apple or Android devices that you own or control, for your own non-commercial use, as allowed by the rules of the store you bought it from. That includes sharing it with your family group through Apple Family Sharing or Google Play Family Library, where those are available.

You may not:

  • copy, sell, rent, lend, or give the app to others, except as the store's rules allow;
  • reverse-engineer, decompile or take apart the app, except where the law says you can despite this restriction;
  • remove our names, logos or notices, or use them to suggest we endorse you; or
  • use the app to break the law or to harm anyone.

We (and our licensors) keep all rights in the app, the games, the artwork, the names "Funstead" and "Funstead Games", and our logo. The app includes some open-source software, which is covered by its own licence; see Settings › Open-source notices in the app.

3. Buying, refunds and restoring

  • One price, once. You pay for the app once, through Apple's App Store or Google Play. The price is shown in the store before you buy, including any tax. The app has no ads, no in-app purchases and no subscriptions.
  • Price changes. We may change the price for new buyers (for example, when Family Connect arrives). That never affects what you've already bought, and you won't be asked to pay again for the app.
  • Refunds are handled by the store you bought from, under its refund policy:
    • Apple: request a refund at reportaproblem.apple.com. Apple decides refunds; we can't issue them for App Store purchases.
    • Google Play: for a recent purchase (usually within 48 hours), request a refund in Google Play. After that, email us at support@funsteadgames.com with your order number, and we'll look at it.
  • A new phone, or a deleted app? Download it again for free from the same App Store or Google Play account. Your photos and stories live on the old phone (see the Privacy Policy), so you'll pick photos again on the new one.
  • Everything is included. We don't sell extra games, levels or features inside the app. If we ever offer something new for sale, it will be optional, and it won't take away anything you already have.

4. Changes and updates

We update Funstead from time to time to fix problems, add games and keep it working with new versions of iOS and Android. Some updates may need a newer phone or operating system. We may change or remove a feature or a game, for example if it stops working well or we can't keep offering it. We'll try not to remove anything that people rely on, and if we do, we'll tell you in the app's What's New notes.

5. Your photos, names and stories

Everything you put into the app (photos, names, Stories, voice recordings) belongs to you. In the app, it stays on your phone and we never receive it, so these terms give us no rights to it.

Please only use photos and recordings you're entitled to use. When you share something from the app using the phone's share sheet, the app you share to (Messages, email and so on) is responsible for it, under its own terms.

6. Family Connect

When this section takes effect: on the day the Funstead update with Family Connect is released, planned for December 2026. Until then, Family Connect isn't available and this section doesn't apply.

6.1 What it is, and who can use it

Family Connect lets up to six family members send photos with captions to a player's Funstead games, and choose the games on the player's home screen, from family.funsteadgames.com. It's included with the app: there's nothing to buy.

To create an account you must be 18 or older, and you must be setting up Family Connect for, or invited by, a family member of someone who plays Funstead. One person in each family is the organizer (the person who set it up, or the person it passes to).

6.2 Your account

You sign in with a link we email you; there's no password. Keep your email account secure, because anyone who can read your email can sign in as you. Use your real first name, because the player sees it with your photos. You're responsible for what happens in your account. Tell us at once at support@funsteadgames.com if you think someone else has used it.

6.3 Your photos and captions: what you keep, and what you let us do

  • You keep ownership of the photos and captions you add ("your content").
  • You give us permission to run Family Connect with it. That means a worldwide, non-exclusive, royalty-free licence to store, copy, resize, process, send and display your content, only to provide Family Connect: to show it to the members of your family, deliver it to the player's connected phone (where it appears in the games), include it in the family's downloads, keep backups, and handle reports. We don't use your content for advertising, publish it, sell it, or use it to train AI.
  • This licence ends when your content is deleted from Family Connect (by you, the organizer, or us), except for copies in our backups, which are erased within 30 days, and anything we must keep by law. Photos already delivered to the player's phone stay there until they're removed in Family Connect or the player deletes them, as the Privacy Policy explains.

6.4 Only add photos you have the right to share

When you add a photo, you promise that:

  • you took it, or you have the right to share it with your family this way;
  • the people in it wouldn't object to it being shared within your family, and for a child, you have their parent's or guardian's permission; and
  • it doesn't break these terms or the law.

If someone in a photo (or a child's parent or guardian) asks us to remove it, we will, whether or not they're in the family.

6.5 What's not allowed

Family Connect is for family photos, shared kindly. Don't add, or use Family Connect for:

  • nudity or sexual content of any kind, and never anything that sexualizes or endangers a child;
  • violence, gore, threats, or content that encourages harm;
  • hateful, harassing, bullying or demeaning content;
  • photos of anyone who has asked not to be shared, or private information about other people (such as addresses, ID documents or medical records);
  • anything illegal, or that infringes someone else's copyright, privacy or other rights;
  • ads, spam, scams, or anything unrelated to family photos; or
  • attempts to get into other families' information, overload or attack our systems, get around limits or blocks, scrape the service, or use it with automated tools.

6.6 Reports, blocks and removal

  • Anyone in the family can report a photo, and the player can hide or report any photo, or stop photos from one person, from the phone.
  • The organizer can remove any photo, remove a person, and block them from rejoining.
  • We review reports, usually within 24 hours. We may remove content, remove someone from a family, or suspend or close an account, with or without notice, if we believe it breaks these terms or the law, or puts someone at risk. We report illegal content to the authorities where the law requires it.
  • Copyright. If you believe a photo infringes your copyright, email support@funsteadgames.com with the details required by the Digital Millennium Copyright Act (who you are, the work, where the photo is, a statement of good faith, and your signature).

6.7 Availability, limits and changes

  • Family Connect is provided as an included extra. We'll work hard to keep it running, but it may sometimes be unavailable, for example for maintenance or because of problems with the internet or our providers.
  • Limits: up to 6 people, 3 connected phones, and the family's 1,000 newest photos per family, plus daily upload limits that prevent abuse. We won't lower the people and photo limits for an existing family.
  • We may change how Family Connect works. If we ever decide to close Family Connect, we'll give at least 90 days' notice by email, with a way to download every photo. The games themselves keep working on the phone without it.

6.8 Ending your account

You can delete your account, or (as organizer) the whole family, at any time in Settings on the website. We may suspend or close an account that breaks these terms. If we close your account for a reason other than a serious breach, we'll give you a chance to download your photos first.

7. Using Funstead fairly

Whatever part of Funstead you use, please don't misuse it: don't try to break, overload, copy or interfere with it, don't access it in ways we didn't intend (for example, by scraping or with bots), and don't use it to harm anyone or to break the law.

8. For fun, not medicine

Funstead is a set of games, made to be relaxing and enjoyable. It isn't a medical device or a health or "brain training" product, and it isn't designed or tested to diagnose, treat, slow or prevent memory loss, dementia, cognitive decline or any other condition. Nothing in Funstead is medical advice. If you're worried about your health or a loved one's, please talk to a doctor.

9. Other companies' services

Funstead works with services run by other companies, such as the App Store, Google Play, Family Sharing, iCloud, the phone's share sheet, and the apps you share to. Those services have their own terms and privacy policies, and we're not responsible for them.

10. Disclaimers

We make Funstead with care, and we want it to work well. But, to the fullest extent the law allows, Funstead is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that Funstead will always be available, error-free or secure, that it will work on every device, or that photos or stories will never be lost. Please keep your own copies of photos and recordings that matter to you. (The app's Stories page can share all stories as one file, and Family Connect lets you download the family's photos.)

Some places don't allow certain warranties to be excluded, so some of this section may not apply to you. Nothing in these terms limits rights you have under consumer protection law that can't be limited by agreement.

11. Limitation of liability

To the fullest extent the law allows:

  • We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, or emotional distress, arising from or related to Funstead, even if we were told they were possible.
  • Our total liability for all claims related to Funstead is limited to the greater of (a) the amount you paid for the app, or (b) US $20.

These limits apply whatever the legal theory (contract, tort, negligence or otherwise). They don't apply to liability that can't be limited by law, such as for our fraud, or for death or personal injury caused by our negligence where the law doesn't allow it to be limited.

12. If you break these terms

If your use of Funstead, or content you add to Family Connect, breaks these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim, to the extent the law allows.

13. Apple App Store terms

This section applies if you got the app from Apple's App Store. If it conflicts with anything else in these terms, this section wins for the App Store version.

  • The agreement is between you and us, not Apple. We, not Apple, are solely responsible for the app and its content. These terms can't give you more rights than the App Store's Usage Rules in the Apple Media Services Terms and Conditions allow.
  • Licence. Your licence (Section 2) is a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules, except that it may be used by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. We, not Apple, are solely responsible for maintenance and support of the app. Apple has no obligation at all to provide maintenance or support for the app.
  • Warranty. We, not Apple, are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, not Apple's.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
  • Intellectual property. If a third party claims that the app, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  • Questions, complaints and claims about the app go to us (see "Contact us" below), not to Apple.
  • Third-party terms. You must comply with any applicable third-party terms (for example, your wireless data agreement) when using the app.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

14. Google Play terms

If you got the app from Google Play, your purchase is also governed by the Google Play Terms of Service, and refunds follow Google Play's refund policies (Section 3). Google isn't a party to these terms and isn't responsible for the app. If you use Google Play Family Library, family members' use of the app is also covered by these terms.

15. Disputes and governing law

  • Talk to us first. Most problems can be solved quickly. Before starting any legal claim, please email support@funsteadgames.com with your name, a description of the problem and what you'd like us to do. We'll try to resolve it within 30 days.
  • Governing law. These terms, and any dispute about Funstead, are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules.
  • Where. Any dispute that isn't resolved informally will be decided by the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court if it qualifies. If you're a consumer living outside California, nothing here takes away the protection of mandatory laws where you live, or your right to bring a claim in your local courts where the law gives you that right.

16. Ending these terms

You can stop using Funstead at any time by deleting the app (and your Family Connect account, if you have one). We may end your right to use Funstead if you seriously or repeatedly break these terms. Sections 2 (our ownership), 5, 6.3 (as it applies to backups), 8 and 10 to 18 keep applying after these terms end.

17. Changes to these terms

We may update these terms, for example when we add a feature like Family Connect or when the law changes. We'll post the new version here and change the "Last updated" date. If a change is significant, we'll also tell you before it takes effect: in the app's What's New notes, on this page, and, for Family Connect members, by email. Changes don't apply to disputes that started before the change. If you keep using Funstead after a change takes effect, the new terms apply; if you don't agree, please stop using Funstead.

  • Whole agreement. These terms (with the Privacy Policy, and the store's terms where they apply) are the whole agreement between you and us about Funstead.
  • If part doesn't work. If any part of these terms is found unenforceable, the rest stays in effect, and that part is applied as far as the law allows.
  • No waiver. If we don't enforce a part of these terms right away, we can still enforce it later.
  • Transfer. You can't transfer these terms to someone else. We may transfer them, for example if our company is renamed (we plan to become Funstead Games LLC), merged or sold, as long as your rights under them don't get worse.
  • Notices. We'll contact you by email (for Family Connect members), in the app, or on this website. You can contact us at support@funsteadgames.com.
  • California users: under California Civil Code Section 1789.3, California users are entitled to this consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
